Non-Employees in Company Vehicles

  It’s not just the insurance company that doesn’t want extra people in your company vehicles, the FMCSA actually prohibits non-employees from riding in Commercial Motor Vehicles, unless they are specifically named in a signed and dated authorization form.

Many employers unknowingly allow such passengers, only to find out the hard way during a roadside inspection.

If your company does choose to allow this, there are a few things to be aware of:

  • The passenger (s) may not have a CDL.
  • The passenger is not allowed to perform any type of work for the company (especially driving).
  • You may want to disallow minor passengers as the potential insurance claims are typically higher for minors due to their projected life span.
  • It goes without saying but picking up hitchhikers is not a good idea.
  • Make sure you have each passenger sign an up to date “Hold Harmless” agreement.
  • Be aware of allowing non-employees in Company vehicles during inclement weather.
  • Discuss coverages, do’s and don’ts with your insurance company before implementing this or any other policy.
